Terms of Service

VivAddie is an AI-assisted marketing platform. It analyzes a website or brand you provide to build a brand profile, then helps you create, review, schedule and publish marketing content — including campaign concepts, copy, imagery and other creative assets — across connected channels.

You are responsible for keeping your account credentials confidential, for all activity under your account, and for ensuring that anyone using VivAddie on your behalf is authorized to do so. You must provide accurate account information and keep it current.

You may use VivAddie only for lawful purposes and only in connection with brands, businesses and content you have the right to manage.

You retain all rights you hold in the content, assets, brand materials and website URLs you upload or submit to VivAddie. You grant VivAddie a limited, non-exclusive license to host, store, process, transform, render and display that content solely to provide and operate the service — including generating campaigns, rendering assets and publishing to destinations you connect.

You are solely responsible for your content and for everything you publish using VivAddie. That includes ensuring its accuracy, that you hold the necessary rights and approvals, that it complies with applicable law and platform rules, and that any required internal review or client approval has taken place before content goes live.

VivAddie uses AI to generate and assist with campaign concepts, copy, imagery, layouts and other creative outputs. Generated content may contain inaccuracies, errors, visual artifacts or unintended similarities to existing works. It is provided as a starting point, not a finished, verified work.

You must review generated content before relying on or publishing it. VivAddie does not warrant that generated content is accurate, original, non-infringing or suitable for any particular purpose. See our Image & AI Content Notice for more detail.

VivAddie can connect to third-party platforms such as Meta (Facebook Pages and eligible Instagram professional accounts) so you can schedule and publish content to destinations you control. When you connect such an account, you authorize VivAddie to act on your behalf within the permissions you grant.

Scheduling and publishing depend on the availability, permissions, APIs and policies of those third-party platforms, which we do not control. VivAddie does not guarantee that any third-party platform will accept, publish, distribute, display or maintain your content, or that it will remain available once published. Third-party platforms may remove, restrict, reformat or deprioritize content at their own discretion. Your use of each connected platform remains subject to that platform's own terms and policies.

You retain your rights in your uploaded content, as described above. VivAddie owns the service itself — the software, interface, systems, design and underlying technology — and all rights in them, except for your content. Nothing in these terms transfers ownership of VivAddie to you, or of your content to VivAddie.

Subject to your compliance with these terms and to the rights of third parties, the campaign assets VivAddie generates for you are yours to use in your marketing. Because AI outputs can resemble existing works, you remain responsible for reviewing them before use (Section 4).

You may not use VivAddie to:

• Create or publish content that is unlawful, defamatory, deceptive or misleading
• Infringe intellectual property, publicity, privacy or other rights of any person
• Analyze, scrape or submit websites or content you have no right to use
• Impersonate others or misrepresent the origin of content
• Attempt to access other users' accounts, brands, campaigns or data
• Probe, disrupt, reverse engineer or interfere with the service or its infrastructure
• Publish content through connected platforms in violation of those platforms' rules

We may update, change or discontinue parts of the service over time. We may suspend or terminate your access if you breach these terms, if your use creates risk or legal exposure for us or others, or if required by law. You may stop using VivAddie and request deletion of your account at any time.

VivAddie is provided "as is" and "as available." To the fullest extent permitted by law, we disclaim all warranties, express or implied, including warranties of merchantability, fitness for a particular purpose and non-infringement. We do not warrant that the service will be uninterrupted, error-free or secure, that generated content will be accurate or suitable, or that any third-party platform will publish or maintain your content.

To the fullest extent permitted by law, VivAddie and its operators will not be liable for indirect, incidental, special, consequential or punitive damages, or for lost profits, revenue, data or goodwill, arising from or related to your use of the service. Where liability cannot be excluded, it is limited to the amount you paid us for the service in the twelve months before the claim arose, or, if you paid nothing, to the maximum extent the law allows us to limit it.

You agree to indemnify and hold harmless VivAddie and its operators from claims, damages, losses and expenses (including reasonable legal fees) arising out of your content, your use of the service, your publication of content through connected platforms, or your breach of these terms or of any third party's rights.

These terms are governed by the laws of the jurisdiction in which VivAddie's operating entity is established, without regard to conflict-of-laws rules. Any disputes will be resolved in the courts of that jurisdiction, unless applicable law gives you the right to bring a claim elsewhere.

We may update these terms from time to time. We will update the "Last updated" date above and, for material changes, provide reasonable notice. Continued use of VivAddie after changes take effect constitutes acceptance.
